Salary arrangement for Commune Military Commanders and Deputy Commanders when changing degrees

The Ministry of Home Affairs has issued Official Letter 11185 guiding allowances and salary arrangement when organizing local government at 2 levels to the Department of Home Affairs of Khanh Hoa province.

Khanh Hoa Provincial Department of Home Affairs said that according to the instructions in Official Dispatch No. 962 dated June 14, 2025 of Military Region 5 (mat document) on reviewing and selecting the arrangement of positions of the Military Command (CHQS) and headquarters of the Commune-level CHQS after the merger;

Accordingly, at the time before the arrangement, the Commander of the Military Command at the commune level to ensure the criteria for participating in the Standing Committee of the Commune Party Committee must have a university degree (may include a university degree in another major) and a political qualification level from intermediate level or higher.

In Clause 1 of Instruction No. 4687 dated August 1, 2025 of the Ministry of National Defense on guiding the implementation of Criteria 19.1 in the new rural and advanced new rural commune criteria for commune-level administrative units after the reorganization, there are regulations on the professional qualifications of commune-level military command staff as follows:

The Commander of the Military Command at the commune level is trained at the university level of the military major and the advanced level of political science; the Deputy Commander and Assistant to the Military Command at the commune level are trained at the college level or university level of the military major (Regulation No. 57 of the Secretariat).

This Department wonders whether for cases arranged according to the instructions in Official Dispatch No. 962 dated June 14, 2025 of Military Region 5 above, having a university degree in another major, the salary can be converted to the specialist rank and whether it can be considered meeting the standards on professional qualifications and political qualifications according to regulations or not?

At the same time, for cases assigned to hold the positions of Commander of the Military Command, Deputy Commander, and Assistant to the Military Command at the commune level with college and intermediate levels, arranged before the time the Law amends and supplements a number of articles of the 11 Laws on Military and Defense and Instruction No. 4687 dated August 1, 2025 issued by the Ministry of National Defense, if there are changes in the university and college training levels (in the right major), salaries will be transferred to the corresponding level or wait for instructions from the competent authority.

Regarding the above content, the Ministry of Home Affairs has the following opinions: Regarding training standards for Commanders, Deputy Commanders, and Assistants of the Military Command at the commune level, the Ministry of Home Affairs requests the Department of Home Affairs of Khanh Hoa province to implement according to the provisions of Article 26 of the Law on the Military Police 2019 (amended and supplemented in Clause 13, Article 10 of Law No. 98/2025); on standards for political equality implemented according to Regulation No. 57 dated February 8, 2022 of the Secretariat on subjects, standards and decentralization of political training.

The salary arrangement for Commanders, Deputy Commanders, and Assistants of Commune-level Military Commands when changing their professional qualifications is proposed to be implemented according to the instructions in Point c, Clause 4, Official Dispatch No. 7644 dated September 9, 2025 of the Ministry of Home Affairs.
