Recruitment of Deputy Commander of the Commune-level Military Command as a civil servant

The Lao Dong Newspaper Legal Consulting Office replied:

Official dispatch No. 7644/BNV-CCVC dated September 9, 2025 of the Ministry of Home Affairs on recruitment and salary classification for civil servants who are Commanders, Deputy Commanders, and Assistants of Commune-level Military Commands stipulates as follows:

1. Regarding the positions of Commander, Deputy Commander, Assistant to the Commune-level Military Command: Implement according to the orientation in Official Dispatch No. 7415/BNV-CCVC dated August 31, 2025 of the Ministry of Home Affairs.

2. According to Clause 9, Article 10 of Law No. 98/2025/QH15, the Commander, Deputy Commander, and Assistant to the Commune-level Military Command are civil servants. Accordingly, these cases are recruited according to the provisions of the Law on Cadres and Civil Servants No. 80/2025/QH15 and Decree No. 170/2025/ND-CP2, except for cases where they are cadres and civil servants.

The authority to appoint the Commander, Deputy Commander, and Assistant to the Commune-level Military Command; standards on training qualifications and tasks of the Commander, Deputy Commander, and Assistant to the Commune-level Military Command shall comply with the provisions of the Law on Militia and Self-Defense Forces No. 48/2019/QH14 (amending and supplementing a number of articles in Law No. 98/2025/QH15), the Government's Decree and the Ministry of National Defense's instructions on the implementation of the Law on Militia and Self-Defense Forces; the number of Deputy Commanders and Assistants to the Commune-level Military Command shall comply with the provisions of Clause 2, Article 5 of Decree No. 220/2025/ND-CP

Thus, the recruitment of Deputy Military Commanders at the commune level is implemented as the recruitment of civil servants according to the provisions of the Law on Cadres and Civil Servants 2025.
