Year-end bonus for civil servants according to Decree 73

Ms. Pham Thi Van (character's name has been changed) said that in June 2025, the school where she works had two officials transferred out of the area.

She suggested clarifying, according to the provisions of Decree No. 73/2024/ND-CP, how will the year-end bonus regime for these civil servants be paid: Calculated for 6 months at the old unit and 6 months at the new unit or receive bonuses for the whole year of 2025 at the new unit.

Regarding Ms. Pham Thi Van's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.

The Ministry of Home Affairs said that on June 30, 2024, the Government issued Decree No. 73/2024/ND-CP stipulating the basic salary and bonus regime for cadres, civil servants, public employees and armed forces.

In which, Clause 1 and Clause 2, Article 4 of this Decree stipulate the subjects implementing the bonus regime and assigns the head of the competent authority to manage or delegate the authority to manage cadres, civil servants and heads of public service units to be responsible for developing specific regulations to implement the bonus regime applicable to subjects on the salary list of the agency or unit.

The annual bonus fund prescribed in this Article is outside the reward fund prescribed by the Law on Emulation and Reward, determined by 10% of the total salary fund (excluding allowances) according to the position, title, rank, level and military rank of the subjects on the salary list of the agency or unit.

By the end of January 31 of the following year, if the agency or unit does not use up the year's bonus fund, it cannot transfer the source to the next year's bonus fund.

The organization and implementation of policies for cadres, civil servants and public employees in Son La province is under the authority of the Chairman of the Provincial People's Committee.

Therefore, the Ministry of Home Affairs recommends that you contact the agency managing cadres, civil servants and public employees of Son La province (Department of Home Affairs) for answers.
