Higher seniority period for holding leadership position allowances for commune-level People's Committee leaders

The Government has just issued Decree 07/2026/ND-CP amending and supplementing a number of articles of Decree 204/2004/ND-CP on salary regime for cadres, civil servants, public employees and armed forces, amended and supplemented by Decree No. 76/2009/ND-CP, Decree No. 14/2012/ND-CP, Decree No. 17/2013/ND-CP and Decree No. 117/2016/ND-CP.

In particular, for the leadership position of the People's Committee (PC) of a commune, ward or special zone that is reserving leadership position allowances due to the impact of the reorganization of the apparatus or the reorganization of administrative units according to the regulations of the National Assembly Standing Committee, the Government or has not yet enjoyed the leadership position allowance coefficient for implementing leadership position allowances as follows:

a) In case of reserving the leadership allowance coefficient but the leadership allowance coefficient is higher than the leadership allowance coefficient prescribed in Clause 2, Article 1 of this Decree, the principle shall be: Continue to receive the leadership allowance until the end of the prescribed period, after which time the leadership allowance prescribed in Clause 2, Article 1 of this Decree shall be received.

b) In case from July 1, 2025 to before January 1, 2026, the leadership position allowance coefficient or the leadership position allowance reserved is lower than the leadership position allowance prescribed in Clause 2, Article 1 of this Decree, the principle shall be: Subject to the leadership position allowance and pay social insurance according to the leadership position allowance coefficient prescribed in Clause 2, Article 1 of this Decree or the difference between the leadership position allowance coefficient prescribed in Clause 2, Article 1 of this Decree and the leadership position allowance coefficient prescribed in Clause 2, Article 1 of this Decree, from the date of holding the leadership position of the People's Committee of the commune, ward, or special zone.

2. For the leadership position of a Department under a Ministry when there is no decision to classify the Department for implementation of leadership position allowances as follows:

a) Apply the position allowance coefficient of a type 2 Department as prescribed in Clause 1, Article 1 of this Decree.

b) In case of holding a leadership position, the leadership position allowance is reserved (due to the arrangement of the apparatus from March 1, 2025 as prescribed in the Government's Decree) higher than the leadership position allowance of a Department under a Ministry in Clause 1, Article 1 of this Decree, continue to receive the leadership position allowance until the end of the prescribed period; after this period, the leadership position allowance prescribed in Clause 1, Article 1 of this Decree and Point a of this Clause will be applied.

In case the leadership position allowance has not been applied or the leadership position allowance is reserved lower than the leadership position allowance of a Department under a Ministry as prescribed in Clause 1, Article 1 of this Decree and Point a of this Clause, the leadership position allowance of a Department under a Ministry will be enjoyed according to the principle in Point b, Clause 1 of this Article.
