Arranging non-specialized personnel in villages and residential groups

When implementing the 2-level local government organization model, according to the provisions of the 2025 Law on Organization of Local Government, there are no longer non-specialized positions at commune level, so many localities are focusing on solving this problem.

According to the set roadmap, Nghe An province will review and streamline the internal apparatus of departments, agencies, and branches; arrange public non-business units and state-owned enterprises directly under the Provincial People's Committee in the direction of promoting socialization and financial autonomy.

In particular, the work of arranging villages, residential groups and non-specialized personnel will be implemented in accordance with the requirements in the new situation.

In Khanh Hoa province, this locality is continuing to review and streamline the organizational structure inside departments, agencies, and branches, arranging public non-business units; arranging villages and residential groups in communes and wards and non-specialized personnel in villages and residential groups to be appropriate.

In February 2026, the Hai Phong Department of Home Affairs implemented and completed the review and appraisal of cases of non-specialized workers at the commune level resigning when implementing local governments at 2 levels in the city according to Decree No. 154/2025/ND-CP of the Government regulating staff streamlining.

To date, Hai Phong City People's Committee has approved the subjects of staff streamlining with 1,952 cases meeting the conditions according to regulations.

Policies for non-specialized workers at the commune level are implemented in 3 cases.

In the first case, non-specialized workers at the commune level who have not reached retirement age as prescribed are entitled to regimes according to their years of service.

For people with less than 5 years of service, they are entitled to a one-time allowance equal to 0.8 times the current monthly allowance multiplied by the number of months of service; entitled to an allowance equal to 1.5 times the current monthly allowance for each year of service; entitled to a 3-month current monthly allowance to find a job...

For people with 5 years or more of service and under 5 years of retirement age, they are entitled to a one-time allowance equal to 0.8 times the current monthly allowance multiplied by the number of months of early retirement compared to the retirement age; enjoying an allowance equal to 1.5 times the current monthly allowance for each year of service...

In the second case, for commune-level cadres and civil servants who are arranged to work as non-specialized personnel at the commune level due to the arrangement of commune-level administrative units in the 2023-2025 period, they are entitled to the regimes as prescribed above, but the current monthly salary to calculate allowances is the immediately preceding monthly salary of the commune-level cadre and civil servant title before being arranged to work as non-specialized personnel at the commune level.

In the third case, non-specialized workers at the commune level who have reached retirement age according to the provisions of Appendix I, Appendix II issued together with Decree No. 135/2020/ND-CP or are enjoying retirement benefits, inability benefits are entitled to a one-time allowance equal to 15 months of monthly allowance currently enjoyed.
