New regulations on the number of deputy heads of departments and professional departments after the merger

Hanoi and Ho Chi Minh City are allowed to increase no more than 10 Deputy Directors

The Government has just issued Decree No. 370/2025/ND-CP amending regulations on heads, deputy heads of departments and the number of deputy heads of organizations under departments.

At the time of the state apparatus arrangement, the number of deputy heads of agencies, organizations and units may be more than the prescribed number.

No later than 5 years from the effective date of the decision to reorganize the apparatus of the competent authority, the number of deputy heads of the agency, organization or unit after the reorganization shall comply with the regulations, specifically as follows:

The number of Deputy Directors of the Department is arranged to be an average of 3 people/department;

Departments that are merged or consolidated when implementing the consolidation or consolidation of 2 provincial-level administrative units will have the number of Deputy Directors of the Department increased by 1 person or when implementing the consolidation or consolidation of 3 provincial-level administrative units, the number of Deputy Directors of the Department will be increased by 2 people compared to the number of Deputy Directors of the Department prescribed as above;

In case the department implements a consolidation and merger according to the decision of the competent authority, the number of Deputy Directors of the department after the consolidation and merger will increase by 1 person;

In case the department implements the consolidation and merger according to the decision of the competent authority and continues to implement the consolidation and merger when implementing the consolidation and merger of 2 provincial-level administrative units, the number of Deputy Directors of the department will increase by 2 people or the number of Deputy Directors of the department will be consolidated, merging 3 provincial-level administrative units will be consolidated, the number of Deputy Directors of the department will increase by 3 people compared to the number of Deputy Directors of the department compared to the regulations;

In case specific departments do not implement the consolidation and merger when implementing the consolidation and merger of provincial-level administrative units, the number of Deputy Directors of the department shall comply with regulations.

For Hanoi and Ho Chi Minh City: In addition to the total number of Deputy Directors as prescribed, no more than 10 Deputy Directors may be added;

Based on the criteria and principles for determining the number of deputies prescribed in this Decree, the People's Committees at the provincial level determine the total number of deputies of agencies, organizations and units under their management and decide on the specific number of deputies for each agency, organization and unit according to their authority.

Number of Deputy Heads of Professional and Technical Departments under the Department

Departments under the department with less than 10 civil servant positions are assigned 1 Deputy Head of Department; 10 to 14 civil servant positions are assigned no more than 2 Deputy Heads of Department; 15 or more civil servant positions are assigned no more than 3 Deputy Heads of Department;

For departments that are merged or consolidated, when implementing the merger or consolidation of departments according to regulations, the number of Deputy Heads of Departments will be increased as adjusted for the number of Deputy Directors of Departments.

Departments under the department with 1 to 3 departments and equivalent are assigned 1 Deputy Head of the Department; no departments or 4 departments or equivalent or more are assigned no more than 2 Deputy Heads of the Department;

When branches are merged or consolidated, when departments are merged according to regulations, the number of Deputy Heads of Branches will be increased as for Deputy Heads of Departments.
