Instructions for transferring unemployment benefits to workers
Article 20 of Decree No. 374/2025/ND-CP of the Government guides the transfer of unemployment benefits for employees.
Decree No. 374/2025/ND-CP of the Government effective from January 1, 2026 detailing a number of articles of the Law on Employment on Unemployment Insurance (BHTN).
Article 20 states the content of transferring unemployment benefits:
Employees who have received at least 1 month of unemployment benefits according to regulations and need to transfer the place of unemployment benefits to another province or centrally run city must pay directly or through the National Public Service Portal to request a transfer of unemployment benefits according to Form No. 19 issued with this Decree and send it to the public employment service organization where they are receiving unemployment benefits.
Within 3 working days from the date of receipt of the employee's request, the public employment service organization is responsible for sending a notice of transfer of unemployment benefits to the provincial Social Insurance to stop paying unemployment benefits according to Form No. 20 issued with this Decree.
At the same time, send a letter of introduction according to Form No. 21 issued with this Decree and the application for transferring unemployment benefits to the public employment service organization where the employee is transferred.
- The application for transfer to the place of unemployment benefits includes:
Proposal to relocate to a place to receive unemployment benefits for workers;
introduced letter to transfer to the place of unemployment benefits;
Photo of the decision to receive unemployment benefits;
Photo of decisions to support vocational training, decisions to temporarily suspend unemployment benefits, decisions to continue receiving unemployment benefits (if any);
Photo of monthly job search notification (if any), other documents in the unemployment benefit application.
Within 3 working days from the date of receipt of the application for transfer to the place of unemployment benefits transferred by the employee, the public employment service organization shall send a written request to the provincial Social Insurance of the transferor to continue paying unemployment benefits and issuing health insurance cards to the employee. Document requesting provincial social insurance according to Form No. 22 issued with this Decree.
In case the employee has received the application for transferring the place to receive unemployment benefits but has not yet submitted it to the public employment service organization where he/she was transferred and no longer needs to transfer the place to receive unemployment benefits, the employee must return the application for transferring the place to receive unemployment benefits to the public employment service organization where he/she was transferred.
Within 3 working days from the date of receiving the referral letter to the place of unemployment benefits, the public employment service organization shall send a document requesting the provincial Social Insurance agency to continue paying unemployment benefits and issuing health insurance cards to employees.
