Social pension benefits: People reflect inadequacies in determining the time of receipt
The Department of Social Protection, Ministry of Health has just responded and provided information on determining the time to receive social pension benefits.
Reader P.T.T.T has just sent a question to the Ministry of Health about determining the time to receive social pension benefits.
According to Ms. P.T.T.T, Article 4 of Decree No. 176/2025/ND-CP stipulates: "The period of enjoying the monthly social pension benefits is calculated from the month in which the Chairman of the People's Committee at the commune level signs the decision".
Meanwhile, Article 8 of Decree No. 20/2021/ND-CP stipulates the period of social allowance for the elderly from the time the person reaches the age of 75 or 80 years old in each specific case.
"I would like to ask, so there is a difference between the two above regulations in the time of starting to receive the allowance: is it calculated from the time the elderly reach the prescribed age or from the month the Chairman of the People's Committee at the commune level signed the allowance decision? "I request that the authorities provide specific instructions to ensure the rights of policy beneficiaries" - Ms. T asked.
Regarding this issue, the Department of Social Protection, Ministry of Health responded as follows:
At point b, clause 1, Article 4 of Decree No. 176/2025/ND-CP dated June 30, 2025 of the Government detailing and guiding the implementation of a number of articles of the Law on Social Insurance on social pension benefits stipulates:
"Within 10 working days from the date of receipt of the written request for social pension benefits, the Chairman of the People's Committee at the commune level shall review, verify and standardize the relevant information of the social pension benefits candidate with the national database on population, decide and pay social pension benefits to the candidate according to the law. The period of receiving monthly social pension benefits is calculated from the month in which the Chairman of the People's Committee at the commune level signs the decision".
Therefore, those who have a written request to receive social pension benefits will receive it from the month the Chairman of the People's Committee at the commune level signed the decision.
