Resolving termination allowances for people outside the payroll quota at associations
The Ministry of Home Affairs has submitted to the Government to issue Resolution No. 405/NQ-CP on extending the time for policy settlement for people working outside the staffing quota at associations.
Mr. Pham Van Bach (character's name has been changed) said that the Ministry of Home Affairs has just advised the Government to issue Resolution No. 405/NQ-CP dated December 10, 2025, extending the payment period of severance pay for those working outside the payroll quota at associations at the provincial and district levels to December 31, 2025 according to Resolution No. 07/2025/NQ-CP.
However, according to actual reflections in the locality, there are still a large number of commune-level cadres subject to the regime who have not been paid.
From this situation, Mr. Pham Van Bach proposed that the Ministry of Home Affairs consider, report and advise the Government to issue a further resolution to extend the policy payment period for the remaining group of commune-level cadres in the 2025 budget year.
Regarding Mr. Bach's petition, the Ministry of Home Affairs responded on the Electronic Information Portal.
The Ministry of Home Affairs said that at Point a, Clause 3, Article 7 of Resolution No. 07/2025/ND-CP dated September 17, 2025, the Government requires localities to issue a Resolution of the Provincial People's Council regulating policies and regimes for people working outside the staff quota at associations assigned by the Party and State at the provincial and district levels before July 1, 2025 and requires the payment of policies and regimes to be completed by November 1, 2025.
However, by November 1, 2025, many localities have not issued the above Resolution.
Accordingly, based on the proposal of some localities, the Ministry of Home Affairs has submitted to the Government to issue Resolution No. 405/NQ-CP dated December 10, 2025 on extending the time to resolve policies and regimes for people working outside the staffing quota at associations assigned by the Party and State at the provincial and district levels in Resolution No. 07/2025/NQ-CP, to create conditions for localities to complete the resolution of policies and regimes for these subjects according to the Resolution of the People's Councils of provinces and centrally run cities.
In particular, for commune-level cadres subject to Article 1 of Resolution No. 07/2025/NQ-CP, it is recommended to comply with the provisions of Article 7 of this Resolution.
