Civil servants are only entitled to 80% of their current salary when calculating severance pay
Officials and civil servants are only entitled to 80% of their current salary multiplied by the number of months of allowance when they quit their jobs to implement staff streamlining.
Pursuant to Article 9 of Decree 178/2024/ND-CP amended by Clause 9, Article 1 of Decree 67/2025/ND-CP, the policy on resignation for cadres and civil servants is stipulated as follows:
Cadres and civil servants who are 02 years or more old and have reached the retirement age specified in Appendix I and Appendix II issued with Decree 135/2020/ND-CP and are not eligible for the early retirement policy specified in Articles 7 and 7a, Article 7b of this Decree, if they retire, will enjoy the following benefits:
Receive severance pay:
For those who quit their jobs within the first 12 months from the date of the decision to reorganize the apparatus by the competent authority, they will receive a subsidy equal to 0.8 months of current salary multiplied by the number of months for which the severance allowance is calculated.
For those who quit their jobs from the 13th month onwards from the date of the decision to reorganize the apparatus by the competent authority, they will receive 0.4 months of current salary multiplied by the number of months for which the severance allowance is calculated.
Receive a subsidy of 1.5 months of current salary for each year of work with compulsory social insurance contributions.
Receive social insurance payment period reserved or receive one-time social insurance according to the provisions of the law on social insurance.
Receive a subsidy of 3 months of current salary to find a job.
Thus, cadres and civil servants who are 2 years or more old to retirement age and are not eligible for early retirement policies if they quit their jobs will receive severance pay.
At the same time, if you quit your job within the first 12 months from the date of the decision to reorganize the apparatus by the competent authority, you will receive a subsidy equal to 0.8 months of current salary multiplied by the number of months of severance pay - that is, 80% of current salary multiplied by the number of months of benefits when severance pay is implemented to streamline the payroll.
