finalize the time limit for placement in job positions and corresponding rankings for civil servants

The Government has just issued Decree No. 361/2025/ND-CP regulating civil servant job positions, effective from December 31, 2025.

According to the decree, no later than July 1, 2026, ministries, branches, central agencies, provincial People's Committees, the Office of the National Assembly Delegation and the Provincial People's Council must direct the implementation and issue decisions approving the job positions of agencies and organizations under their management according to the provisions of this Decree to replace previously issued decisions on job positions.

During the period when the competent authority has not issued a decision approving the job position as prescribed in this Decree, the decisions approving the job position previously issued shall continue to apply.

No later than July 1, 2027, ministries, branches, central and local agencies must complete the arrangement to job positions and rank according to job positions for civil servants recruited before July 1, 2025 under their management. The arrangement to the job position and corresponding rankings are implemented as follows:

Arrange to the position of senior specialist and equivalent for civil servants holding the rank of senior specialist and equivalent;

Arrange to the position of main specialist and equivalent for civil servants holding the rank of main specialist and equivalent;

Arrange to the position of specialist and equivalent for civil servants holding the specialist rank and equivalent;

Arrange to the position of cadre and equivalent for civil servants holding the cadre and equivalent;

Arrange to the position of employee for civil servants holding the position of employee.

After being arranged to the job position and assigned to the corresponding rank, in case the actual number of users exceeds the rate prescribed in this Decree, the competent authority will carry out the arrangement and arrangement to ensure that after July 1, 2027, the rate is implemented correctly according to regulations.

During this time, do not change job positions with civil servant ranks according to professional and technical ranks from low to high for job positions that have exceeded the prescribed rate.

This Decree applies to:

Ministries, ministerial-level agencies, organizations established by the Government and the Prime Minister that are not public service units in cases where civil servant management authority is assigned; administrative agencies and organizations under the ministry;

Provincial and municipal People's Committees; specialized agencies, administrative agencies and organizations under provincial People's Committees; Office of the National Assembly Delegation and Provincial and Municipal People's Councils;

People's Committees of communes, wards, and special zones; specialized agencies and administrative organizations under the People's Committees at the commune level.

The competent Party agency shall prescribe the list of job positions and the ratio of civil servants arranged according to job positions in agencies of the Communist Party of Vietnam, the Vietnam Fatherland Front, and socio-political organizations.

The National Assembly Standing Committee, the Office of the President, the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy, and the State Auditor General shall decide on the application of the provisions of this Decree to civil servants in agencies and administrative apparatus under their management.

The Minister of National Defense and the Minister of Public Security shall decide on the application of the provisions of this Decree to civil servants working in agencies, organizations and units under their management.
