The Ministry of Construction guides the determination of the cost of monitoring the installation of equipment in the project

On the Government Portal, Mr. N.L reflected that Clause 39, Article 3 of the Construction Law stipulates that equipment installed in works includes construction equipment and technological equipment.

Construction equipment is equipment installed in construction works according to construction designs. Technology equipment is equipment within the technology chain installed in construction works according to technological designs.

According to Circular No. 12/2021/TT-BXD of the Minister of Construction promulgating the construction norms, the cost of monitoring and installing equipment is determined according to the percentage (%) (issued in Table 2.22 attached to this Circular) multiplied by the equipment cost (no value added tax) in the equipment package estimate.

In Mr. N.L's locality, some investment projects in construction include the items of purchasing common equipment ( tables, chairs, cabinets, computers, washing machines, trays, cabinets, counters, heaters, fans, trash bins...) or equipment in the fields of health, education, sports... (breathing machines, injection pumps, surgical knives, beds, student desks, chairs, laboratory equipment, sports equipment...) approved by the investor (no construction design or technological design approved.

Including the supervision cost items for these equipment are determined according to the percentage of the equipment installation supervision cost issued in Table 2.22 attached to Circular No. 12/2021/TT-BXD above.

Mr. L asked, is the investor's determination of the cost of monitoring the above equipment in accordance with regulations?

In case it is not in accordance with regulations, he recommended that the Ministry of Construction promptly give instructions on how to determine the budget for the supervision of these equipment so that the locality has a basis to manage construction investment costs to ensure current regulations.

According to the provisions of Clause 39, Article 3 of the 2014 Construction Law:

"The equipment installed in the project includes construction equipment and technological equipment. Construction equipment is equipment installed in construction works according to construction designs. Technology equipment is equipment within the technology line installed in construction works according to technological designs".

Thus, for construction investment projects with equipment installed in the project according to the design, the cost of monitoring the installation of equipment is determined according to the provisions of Point 8.3, Section 8, Chapter II, Part II, Appendix No. VIII of Circular No. 12/2021/TT-BXD of the Minister of Construction on promulgating construction norms.
