Ministry of National Defense will amend regulations on the position of commander of the Self-Defense Militia
The Ministry of National Defense is assigned to amend a number of regulations related to the Military Command of communes and village commanders in the Law on Militia and Self-Defense Forces.
On January 28, according to the Government Electronic Information Portal, the above content was assigned by the Government to the Ministry of National Defense to propose specific amendments in 2026.
In the appendix to the list of legal normative documents that need to be amended and supplemented related to Resolution No. 66.12/2026/NQ-CP dated January 26, 2026 on the organization and operation of the Military Commands of communes, wards, special zones directly under the Provincial Military Command, centrally-run cities, Hanoi Capital Command, Ho Chi Minh City Command, the Government assigned the Ministry of National Defense in 2026 to propose amendments to a number of regulations related to the Military Commands of communes and village commanders in the Law on Militia and Self-Defense Force No. 48/2019/QH14 as follows:
Amending regulations on the position of militia commander:
Amending the regulations on the position of commander of the Self-Defense Militia in Clause 1, Article 19 of the Law on Self-Defense Militia No. 48/2019/QH14 amended and supplemented by Law No. 98/2025/QH15:
1. The commanding positions of the Military Command of commune level, the Military Command of agencies and organizations include:
a) Commander, Political Commissar;
b) Deputy Commander, Deputy Political Commissar.
Amending regulations on the Military Command of communes and village commanders in Clause 1, Article 20:
1. The commune-level Military Command is the standing agency for national defense work at the commune level. The division of the commune-level Military Command includes:
a) The Commander is a civil servant, a member of the People's Committee at the commune level, a reserve officer; in an emergency situation of national defense, war situation, they are called to serve in active duty according to the provisions of the Law on Officers of the Vietnam People's Army and continue to hold the position of Commander of the Military Command at the commune level;
b) Political Commissar assigned by the Secretary of the commune-level Party Committee;
c) Deputy Political Commissar held by the Secretary of the Ho Chi Minh Communist Youth Union at the commune level;
d) Deputy Commander and Assistant are civil servants".
