The Commune-level Military Command will have legal status and its own account

On January 11, according to information from the Government's Electronic Information Portal, the Ministry of Justice is reviewing the Draft Resolution dossier of the Government on the organization and operation of the Military Command (MCS) of communes, wards and special zones.

Accordingly, implementing the policy of sending military officers to participate in the Commune-level Military Command in Conclusion No. 228-KL/TW dated December 31, 2025 of the Politburo and the Secretariat on the situation and results of the operation of the apparatus of the political system and local governments at both levels; based on the provisions of the Law on Promulgation of Legal Documents 2025 and Resolution No. 206/2025/QH15 dated June 24, 2025 of the National Assembly on the special mechanism for handling difficulties and problems due to legal regulations, the Ministry of National Defense will develop a Draft Resolution on legal regulations of the Government on the organization and operation of the Military Commands of communes, wards and special zones.

The draft Resolution was developed to arrange the Military Command at the commune level in accordance with the political system, the viewpoint of the guidelines for national defense and people's war.

Build a regular commune-level Military Command, have a balanced organizational structure, in accordance with local government at 2 levels, and be the core force in building a national defense posture, a people's war posture associated with a people's security posture, meeting the requirements of the task of protecting the Fatherland in the new situation.

The draft Resolution includes 8 articles regulating the organization, operation, and policies of the Military Command at the commune level.

The content of the Resolution focuses on regulating the organization, operation, regimes and policies of the Commune-level Military Command during the period of not amending, supplementing or promulgating new laws related to this agency.

In which, the Military Command at the commune level is a local military agency under the Military Command of a province or centrally-run city, the Hanoi Capital Command, and the Ho Chi Minh City Command; under the leadership, direction, and operation of local Party committees and authorities at the same level.

The Military Command at the commune level has its own legal status, seal, account, headquarters and performs a number of tasks such as: Training, combat readiness; building forces; building and operating defense areas; National Defense and Security Education; Logistics - Technical work; applying information technology and digital transformation in the military and defense sector according to the provisions of law; receiving complaints, denunciations, preventing and combating corruption and handling, proposing to handle disciplinary and legal violations according to authority; performing other tasks according to the provisions of law and orders of the superior Commander.

In the coming time, the Ministry of National Defense will receive comments for appraisal, thorough review, and complete the draft Resolution to submit to the Government for consideration and decision.
