Priority order for buying social housing among groups of subjects

Decree 100/2024/ND-CP is amended by Decree 54/2026/ND-CP stipulating the order of priority for buying social housing.

Based on the provisions of Clause 1, Article 38 of Decree 100/2024/ND-CP amended by Article 34 of Decree 54/2026/ND-CP (effective February 9, 2026) on social housing purchase as follows:

Article 38. Order and procedures for selling, leasing, buying, and leasing social housing invested in construction according to projects and not using public investment capital, trade union financial sources

1. Order and procedures for selling social housing are implemented as follows:

h) In case the project has priority subjects as prescribed in point d, clause 1, Article 79 of the Housing Law, it is prioritized to buy social housing without having to draw lots with the number of apartments equal to the total number of eligible dossiers of these priority groups out of the total number of eligible dossiers in the list specified in this clause multiplied by the total number of apartments/social housing houses expected to be sold.

Prioritizing female subjects is applied to cases where the applicant is a single female or must be the head of household of the household based on the residence database.

Priority subjects specified in point d, clause 1, Article 79 of the Housing Law are arranged apartments/houses in the following order: people with meritorious services to the revolution, relatives of martyrs, people with disabilities, people arranged for resettlement in the form of buying social housing, women. In case the number of priority subjects in 1 group exceeds the number of remaining priority apartments/houses, a draw is conducted between that group of priority subjects, the remaining subjects are allowed to continue to participate in the draw along with the non-priority subjects;

At the same time, based on the provisions of point d, clause 1, Article 79 of the 2023 Housing Law amended by point h, clause 3, Article 29 of the 2025 Population Law as follows:

Article 79. Principles for implementing social housing support policies

1. The implementation of social housing support policies must ensure the following principles:

e) In case one subject enjoys many different support policies, they are entitled to one support policy at the highest level; in case the subjects have the same standards and conditions, support is carried out in the order of priority first for: people with meritorious services to the revolution, relatives of martyrs, people with disabilities, people arranged for resettlement in the form of buying or renting social housing, people with 02 or more biological children, women;

Thus, the order of priority for buying social housing among groups of subjects is arranged as follows:

(1) People with meritorious services to the revolution,

(2) Relatives of martyrs,

(3) People with disabilities,

(4) People who are arranged for resettlement in the form of buying or renting social housing,

(5) People with 2 or more biological children,

(6) Women (The applicant is a single female or is the head of household of the household based on the residence database).
