First appointment of a Judge of the People's Court with 5 conditions
One of the conditions for proposing the appointment of a judge of a People's Court is to be assessed and classified as a civil servant who "complets his/her duties well" or better.
The Chief Justice of the Supreme People's Court (SPP) issued Circular No. 02/2026/TT-TANDTC regulating procedures and documents for proposals for appointment, reappointment, consideration of promotion, transfer, secondment, dismissal, and removal of the position of SPP Judge and taking effect from January 15, 2026.
The Circular mentions the conditions and procedures for proposing the first appointment of a Judge of the People's Court.
Accordingly, the person recommended to be appointed as a People's Court Judge must meet the following conditions:
Meet the standards and conditions for appointing People's Court Judges as prescribed in Articles 94 and 95 of the Law on the Organization of the People's Court No. 34/2024/QH15, which have been amended and supplemented with a number of articles under Law No. 81/2025/QH15, Law No. 142/2025/QH15 and Law No. 150/2025/QH15;
Not being subject to disciplinary action or being considered for disciplinary action;
The results of the assessment and classification of civil servants in the 3 consecutive years before the time of the appointment proposal must be assessed and classified as civil servants "Completing the task well" or higher;
The age of appointment must meet the provisions of Clause 2, Article 100 of the Law on the Organization of the People's Court;
Not being held liable according to the regulations of the Chief Justice of the People's Court on handling the responsibility of those holding judicial positions in the People's Court.
The appointment application includes:
Proposal for appointment;
List of personnel proposed for appointment;
Resolution of the Provincial People's Court Committee or document of the competent authority to the military courts on the consensus of the appointment proposal;
The comments, assessments and minutes of the meeting to comments and assess the quality of the trial of the People's Court Judge working at the Provincial People's Court and the Regional People's Court;
The document recognizing the results of the People's Court Judge selection exam for cases of first appointment as People's Court Judges is stipulated in Clause 1, Article 95 of the Law on Organization of the People's Court.
