Avoiding the obligation to provide support between husband and wife after divorce is fined up to 10 million VND

The Lao Dong Newspaper Legal Consulting Office replied:
Article 43 of Decree 282/2025/ND-CP (effective from December 15, 2025) stipulates violations of regulations on care, nurturing, and nutrition as follows:
1. Fine from 5 million VND to 10 million VND for one of the following acts:
a) Reject or evade the maintenance obligation between husband and wife after divorce; refuse or evade the maintenance obligation between husband, wife, sister together, between grandparents, paternal grandparents and grandchildren according to the provisions of law;
b) Reject or evade the obligation to provide for and care for father and mother; the obligation to provide for and care for children after divorce according to the provisions of law.
2. Remedial measures:
Forced to fulfill the obligation to contribute and nurture according to regulations for violations specified in Clause 1 of this Article.
Thus, from December 15, 2025, evasion of maintenance obligations between husband and wife after divorce can be fined up to 10 million VND.
