Procedures for reappointing civil servants in leadership and management positions
Decree 170/2025/ND-CP regulates the recruitment, use and management of civil servants.
In which, the procedure for reappointing civil servants in leadership and management positions is based on Article 39.
Article 39. Procedures for reappointment
1. No later than 90 days before the appointment deadline, the competent authority appointing civil servants must issue a notice of implementation of the process of re-appointment consideration for civil servants.
2. Civil servants who make reports self-assessment and evaluation of the performance of duties and tasks during their term of office shall submit them to competent authorities for appointment.
3. Organizing a conference of key officials to collect opinions on the reappointment
Components: Implement as prescribed in step 4 of the process of appointing civil servants to leadership and management positions.
Implementation procedures: Civil servants are considered for reappointment to report on self-assessment and assessment of the performance of duties and tasks during their tenure; the conference participates in giving opinions and voting for confidence by secret ballot for civil servants considered for reappointment.
The conference minutes and vote counting minutes are sent to the competent authority for appointment. The vote counting results were not announced at this conference.
4. The head of the agency, organization or unit directly uses civil servants to evaluate, comment and propose the reappointment.
5. The collective leadership of agencies, organizations, and units discussed and voted on personnel:
Components: Implement as prescribed in Point d, Clause 2, Article 33 of this Decree (step 5).
Implementation procedures:
Analyzing the voting results at key officials conferences. Civil servants proposed for reappointment must reach over 50% of the number of referral votes (based on the total number of people called up to attend key staff conferences); in case of reaching 50%, it will be considered and decided by the head; in case of reaching less than 50%, it will be reported to the competent authority for consideration and decision on continuing to implement the process.
Verify and conclude newly arising issues (if any).
Receive written opinions from the same-level Party Committee on the proposed personnel for reappointment.
The collective leadership discussed, evaluated, commented and voted on personnel by secret ballot. Personnel proposed for reappointment must reach over 50% of the number of referral votes of the leadership team; in case the personnel reaches 50%, the head will decide according to authority or submit to the competent authority for consideration and decision; in case it reaches less than 50%, the different opinions must be fully reported to the competent authority for consideration and decision.
The head of the agency, organization or unit shall issue a decision to reappoint according to his authority or submit it to the competent authority for consideration and decision.
