New regulations on public service units under ministries from November 20, 2025
Regulations on public service units under ministries from November 20, 2025 are mentioned in Decree 303/2025/ND-CP.
Article 13 of Decree 303/2025/ND-CP (effective from November 20, 2025) stipulates the public service units under the ministry as follows:
- The establishment, reorganization, and dissolution of public service units shall comply with the provisions of the Government and the provisions of specialized laws.
- Public service units without state management functions.
- Public service units implement the autonomous mechanism on tasks, organization, personnel and finance according to the provisions of law.
- Public service units with legal status, their own seal and account.
According to Clause 1, Article 9 of the Law on Civil Servants 2010, public service units are organizations established by competent State agencies, political organizations, and socio-political organizations in accordance with the provisions of law, with legal status, providing public services, and serving state management.
In addition, Clause 1, Article 3 of Decree 120/2020/ND-CP stipulates the status of public service units abroad as follows: Public service units abroad are public service units under ministries, ministerial-level agencies or under government agencies established by competent State agencies, with legal status, having their own seal and account according to the provisions of law and having headquarters abroad.
