New regulations on the transfer and removal of Chairman and Vice Chairman of the People's Committee

The Lao Dong Newspaper Legal Consulting Office replied:

Article 10, Decree 300/2025/ND-CP (effective from November 17, 2025) stipulates the framework for the number of Vice Chairmen of the People's Committee, the number and structure of members of the People's Committee; the order and procedures for proposing to approve the results of the People's Council electing, dismissing, and removing Chairmen and Vice Chairmen of the People's Committee; the order and procedures for transferring and removing Chairmen and Vice Chairmen of the People's Committee and assigning the authority of Chairmen of the People's Committee, regulations on transferring and removing Chairmen and Vice Chairmen of the People's Committee as follows:

1. Based on the task requirements and the opinions of competent authorities according to the decentralization of personnel management, the Prime Minister decides to transfer the Chairman and Vice Chairman of the Provincial People's Committee at the request of the Minister of Home Affairs; the Chairman of the Provincial People's Committee decides to transfer the Chairman and Vice Chairman of the Commune People's Committee at the request of the Director of the Department of Home Affairs.

2. When the Chairman or Vice Chairman of the People's Committee violates the law or does not properly perform his assigned duties and tasks, based on the opinions of competent authorities according to the decentralization of personnel management, the Prime Minister decides to remove the position of Chairman and Vice Chairman of the Provincial People's Committee at the request of the Minister of Home Affairs; the Chairman of the Provincial People's Committee decides to remove the position of Chairman and Vice Chairman of the Commune People's Committee at the request of the Director of the Department of Home Affairs.

3. The Chairman and Vice Chairman of the People's Committee may be transferred or dismissed from their duties as Chairman and Vice Chairman of the People's Committee from the date the decision on transfer or dismissal takes effect.

Thus, the transfer and removal of the positions of Chairman and Vice Chairman of the People's Committee according to the new regulations as above.
