The Chairman of the People's Committee of the commune has the authority to decide on citizens performing their duty to participate in militia and self-defense forces.

Article 10 of the 2019 Law on Militia and Self-Defense Forces amended by Clause 3, Article 10 of the Law amending 11 Laws on Military and Defense 2025 (effective from July 1, 2025) stipulates standards, selection and authority to decide citizens to perform their duties in the Militia and Self-Defense Forces:

1. Vietnamese citizens who are of service age and meet the following standards are selected for militia:

2. Admission to the militia and self-defense force is regulated as follows:

a) Ensure publicity, democracy, and compliance with legal regulations;

b) Every year, the Hanoi Capital Command, the Ho Chi Minh City Command, and the Provincial Military Command direct and guide the Commune People's Committees, agencies, and organizations to select citizens to perform their duty to join the militia and self-defense force.

3. Reserve soldiers who have not been arranged in the reserve unit are encouraged to be recruited into the militia and self-defense unit.

4. Chairman of the People's Committee at the commune level, the head of the agency or organization deciding that citizens perform their duty to join the Militia and Self-Defense Forces.

5. The Minister of National Defense shall detail Clause 1 of this Article.
