Funeral support regime when leaving office for retired military officers

The Lao Dong Newspaper Legal Consulting Office replied:

Article 7, Decree 343/2025/ND-CP (effective from January 1, 2026), stipulates the regime for funeral support when passing away as follows:

1. The regime of supporting the organization of funerals and tomb construction for retired military officers who are subjects of state-level funerals and high-level funerals shall comply with the provisions of current law.

2. Funding support for agencies and units presiding over the organization of funerals or participating in the Funeral Organizing Committee as prescribed by the Ministry of National Defense for retired Army officers with a military rank of Colonel or less who are not eligible for funeral arrangements as prescribed in Clause 1 of this Article, as follows:

a) For the agency or unit presiding over the funeral

Units under the Ministry of National Defense are supported with 10 times the basic salary;

Departments and equivalents under the Ministry of National Defense, the General Staff, the General Department of Politics and General Departments are supported with 08 times the basic salary;

Agencies and units at the Division level, Provincial Military Commands and equivalent are supported with 05 times the basic salary;

The remaining agencies and units are supported with 03 times the basic salary;

The budget for supporting the agency or unit in charge of organizing the funeral is specified in this point to purchase worship items, decorations for the ceremony, wreaths, visits and expenditures for the funeral.

b) For agencies and units assigned to participate in the Funeral Organizing Committee, they will be supported with 01 time the basic salary; this fund is used to buy wreaths, visits and ceremonial items according to local customs and practices.

c) Every year, the agency or unit presiding over the funeral or assigned to participate in the funeral Organizing Committee shall pay and settle the actual expenditure but not exceed the support level prescribed in Point a and b of this Clause.

Thus, from January 1, 2026, the funeral support regime when leaving the ceiling for retired military officers is regulated as above.
