Procedure for collective bargaining, signing and organizing the implementation of collective labor agreements

5. Step 5. Agree on the time for electronic payment and send a draft CLA

- The Executive Committee of the Trade Union sends the draft Collective Labor Agreement to the employer.

- Agree on the time to organize theTTTT session (Annex No. 9 - Document proposing to organize theTTTT session).

6. Step 6. Organizing the TLTT session

Conducting theTTTT session and making aTTTT record. If there are multipleTT sessions, each session will have 01 separateTT record (Annex No. 10 -TT record).

7. Step 7. Getting opinions from the labor collective on the results of the electronic health system

- Based on the results of theTTTT, the Executive Committee of the Trade Union shall send a document to collect opinions on the results of theTTTT (Annex No. 11 - Document to deploy to collect opinions on the results of theTTTT) along with a form to collect opinions (Annex No. 12 - form to collect opinions on the results of theTTTT). If more than 50% of the total number of employees agree, the collective labor agreement will be signed. If equal to or less than 50% of the total number of employees agreeing, negotiations will continue.

- The results of the consultation must be recorded in a report or record (Annex No. 13 - Report on collecting employees' opinions on the results of the electronic consultation).

8. Step 8. Organizing the signing of the Collective Labor Agreement

The signing ceremony can be held separately or combined with the Labor Conference or some other activities of the enterprise.

9. Step 9. Sending a collective labor agreement

After signing the Collective Labor Agreement, the employer is responsible for sending the signed Collective Labor Agreement according to regulations (Annex No. 14 - Official Dispatch to the Collective Labor Agreement).

10. Step 10. Periodic assessment

After 03 months of implementation for collective labor agreements with a term of less than 01 year, after 06 months of implementation for collective labor agreements with a term of 01 year to 03 years, the parties will conduct an assessment of the implementation results of the collective labor agreement to amend, supplement or re-sign or sign a new one (Annex No. 15 - Report on the assessment of the implementation results of the collective labor agreement).
