Applying for a construction practice certificate, the engineer is stuck because there must be notarized drawings

On the Ministry of Construction's Information Portal, citizen T.T.B.H reported:

"I would like to answer the issue of the dossier requiring a notarized copy from the original. However, currently all documents submitted to the construction department, I can only stamp the 2 original sets, and hand them over to the investor, so the entire file is just a scan file.

The requirement to prove that the application for a practice certificate must have notarized documents is not available from the design consultant or construction consultant".

From the above reality, citizens ask, how can this be handled so that engineers are not entangled when encountering cases that require a practice certificate but lack notarized documents?

After studying, the Department of Economics - Construction Investment Management (Ministry of Construction) gave the following opinion:

The dossier for requesting a new practice certificate is stipulated in Clause 1, Article 88 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government.

Accordingly, the documents specified in Points c, d, dd, e of this Clause must be a certified copy or an electronic copy of the information file certified according to regulations.

Details are as follows:

The certificate is issued by a legal training institution in accordance with the field or grade of practice certificate proposed; in case the certificate does not record or not clearly state the training major, it must be accompanied by a scoreboard or certificate appendix to serve as a basis for testing and evaluation (for the certificate issued by a foreign training institution, in case the individual is a foreigner and a Vietnamese person residing abroad must be a consularally legalized copy and a Vietnamese translation must be notarized and certified according to the provisions of Vietnamese law; the remaining cases of the certificate issued by a foreign training institution must be recognized by the Vietnamese education system).

The practice certificate (if any) has been previously issued by a competent authority in accordance with the time and scope of experience testing.

The organization's decisions to assign work ( assign tasks) to individuals or the confirmation document of the investor's legal representative and be responsible for the authenticity of the confirmation of the work that the individual has completed according to the declaration content or documents of specialized construction agencies with content related to the experience of the individual declared; economic contracts and acceptance minutes of the work declared for the case of the individual practicing independently.
