Salary of council members, inspectors who are defense officers and civil servants

The Government has just issued Decree No. 248/2025/ND-CP stipulating the salary, remuneration, and bonus regime for representatives of direct owners, representatives of state capital, and controllers in state-owned enterprises.

Notably, Decree 248/2025/ND-CP stipulates that the maximum salary of council members and full-time inspectors is determined based on the basic salary and performance of the enterprise.

Accordingly, for enterprises with profits and implementation profits not lower than the plan, the maximum salary level is equal to 2 times the basic salary. If the profit is implemented beyond the plan, it is implemented according to the principle that the profit exceeds the plan by 1%, and is calculated an additional 2% of the salary level but not exceeding 20% of the salary level calculated on the basis of 2 times the basic salary.

In case the realized profit is lower than the plan, the maximum salary will be calculated at 80% multiplied by 2 times the basic salary and multiplied by the realized profit ratio compared to the planned profit, but not lower than 80% of the basic salary.

For non-profit enterprises, the maximum salary is 70% of the basic salary.

For businesses that suffer or suffer losses, the maximum salary is determined according to the following regulations: in case of loss, the maximum salary is equal to 50% of the basic salary; in case of loss reduction (including no profit), the loss reduction level is based on the plan to determine the maximum salary is equal to 80% of the basic salary;

For newly established or newly operated enterprises, the maximum salary in the first year of establishment or newly operated must not exceed the basic salary.

Newly established enterprises on the basis of merging enterprises, if the salary is lower than the highest actual salary of corresponding positions in member enterprises before the merger, it will be calculated at the salary of those corresponding positions.

Enterprises that only carry out public products and services are determined to have a salary level associated with the volume of public products and services according to the following regulations:

For the volume of public products and services performed not lower than the plan, the maximum salary is 1.5 times the basic salary, in which for enterprises performing public products and services that play a particularly important role in key and essential fields of the national economy according to the Government's regulations, the maximum salary is twice the basic salary;

The volume of public products and services implemented is lower than the plan, in which the volume of public products and services is lower than this plan due to the fact that the enterprise implements the State's policy or is affected by objective factors, the maximum salary is 1.5 times the basic salary.

The salary level of council members and inspectors who are officers, professional soldiers, defense officials, officers, non-commissioned officers, and people working in secret service when determined according to regulations shall not be lower than the salary level according to the position, title, rank, level, or salary allowances according to the Government's regulations for council members and inspectors who are officers, professional soldiers, defense officials, officers, non-commissioned officers, and people working in secret service.
