New salary for retirees holding leadership positions at associations
The Prime Minister requested to urgently submit to the competent authority to amend the remuneration regime for retired people holding full-time leadership positions at associations.
This is the content stated in Official Dispatch No. 84/TTg-TCCV of the Prime Minister requesting ministries, branches and localities to continue to improve and improve the effectiveness and efficiency of the operation of the 2-level local government model.
The Prime Minister requested the Ministry of Home Affairs to urgently review and propose amendments and supplements to regulations related to labor and employment to ensure compliance with the provisions of the Law on Organization of Local Government, helping localities have a basis to implement the authorization of commune-level People's Committees to effectively carry out management work, in line with the model of local government at 2 levels.
Urgently advise and submit to competent authorities to amend Decree No. 126/2024/ND-CP dated October 8, 2024 of the Government regulating the organization, operation and management of associations and amend Decision No. 30/2011/QD-TTg dated June 1, 2011 of the Prime Minister on remuneration regimes for retirees holding full-time leadership positions at associations after receiving a policy from the Politburo.
According to Decision No. 30/2011/QD-TTg when implementing the 3-level local government model, the monthly remuneration for retired people holding the position of full-time leader at the head of the association is stipulated as follows:
For associations with a scope of activities nationwide or inter-provincial: No more than 6.50 times the general minimum wage;
For associations with scope of activities in provinces and centrally run cities:
Hanoi and Ho Chi Minh City: No more than 5.40 times the general minimum wage;
Other provinces and centrally-run cities: No more than 5.00 times the general minimum wage.
For associations with scope of activities in districts, towns and cities under the province:
Districts in Hanoi and Ho Chi Minh City, cities in the province: No more than 3.60 times the general minimum wage;
Other districts, towns and cities: No more than 3.20 times the general minimum wage.
For associations with a scope of activities in communes, wards and towns: not more than 1.50 times the general minimum wage.
Based on the maximum remuneration for retirees holding the title of full-time leader at the head of the association, the associations specify the monthly remuneration for retirees holding the remaining full-time leadership title to ensure internal correlation, publicity, democracy, transparency and appropriateness.
Regarding the implementation funding source, for associations with specific characteristics: The funding for implementing the remuneration regime is provided annually by the state budget according to the provisions of the law on the state budget.
For the remaining associations, the association guarantees the remuneration regime.
Article 39 of Decree No. 126/2024/ND-CP stipulates that the central budget supports associations assigned by the Party and the State at the central level, including:
Pay salaries, allowances and other regimes and policies according to regulations for people of working age assigned or transferred to work at the association according to the decision of the competent authority and those recruited within the association's staffing quota;
remuneration regime for those who have retired to hold the positions of full-time Chairman and Vice Chairman of the association;
Regular expenditures are calculated according to the allocation norms for state management expenditures, the Party, and organizations such as state administrative agencies at the central level according to the assigned number of positions;
Facilities and means of operation comply with the provisions of the law on land, the law on public assets, the law on state budget and relevant laws.
