Increase land auction deposit to 50% from January 6
The Resolution stipulates that in case of land auction for residential land allocation to individuals, the minimum deposit is 10% and the maximum is 50% of the starting price.
The Government issued Resolution No. 66.11/2026/NQ-CP dated January 6, 2026, regulating the handling of difficulties and problems in land use rights auctions in cases of land allocation according to the provisions of the Land Law.
This Resolution stipulates the deposit for participating in land use rights auctions in cases of land allocation to individuals; handling violations against the auction winner in cases of land allocation in violation of the obligation to pay the land use rights auction winning price according to the provisions of the law on land and other relevant laws.
The Resolution stipulates a number of solutions and mechanisms to prevent profiteering and violations, including the abandonment of land auction deposits. In which, the Resolution stipulates the deposit for participating in land use rights auctions in cases of land allocation to individuals according to the provisions of the Land Law.
Article 39 of the Law on Property Auction 2016 (amended and supplemented in 2024) stipulates that in the case of auctioning land use rights to allocate residential land to individuals, the minimum deposit to participate in the auction is 5% and the maximum is 20% of the starting price.
The Resolution stipulates that in the case of auctioning land use rights in the case of land allocation to individuals according to the provisions of the Land Law, the minimum deposit is 10% and the maximum is 50% of the starting price. Raising the deposit level for land use rights auctions is a solution to prevent the situation of paying high prices for profit and then abandoning the deposit.
The Resolution also provides specific regulations to handle violations against the auction winner of land use rights in cases of land allocation.
According to the Resolution, the auction winner of land use rights in cases of land allocation violating the obligation to pay the auction winning price for land use rights, leading to the decision to recognize the auction result being canceled, depending on the nature and severity of the violation, is prohibited from participating in the auction for land use rights in cases of land allocation as follows:
- From 2 years to 5 years in case the auction winner does not pay the auction winning amount;
- From 6 months to 3 years in cases where the auction winner does not pay the full amount of the auction winning amount.
The competent authority approving the auction results of land use rights in cases of land allocation to individuals is the competent authority deciding to prohibit participation in the auction as prescribed above.
Within 10 days from the date of issuance of the decision to cancel the decision to recognize the auction results of land use rights, the competent authority deciding to prohibit participation in the auction shall review and issue a decision prohibiting participation in the auction for the winner of the land use rights auction according to regulations.
This Resolution takes effect from January 6, 2026 to February 28, 2027.
During the period of validity of the provisions of this Resolution, if the provisions on deposit fees and the prohibition of participation in land use rights auctions in cases of land allocation in this Resolution other than relevant legal documents are implemented in accordance with the provisions of this Resolution.
