Instructions for salary classification for commune-level civil servants when there are changes in degrees
The salary arrangement for commune-level civil servants is implemented consistently according to the general salary regime applicable to cadres and civil servants according to regulations.
The Ministry of Home Affairs has provided guidance on salary arrangement for commune-level cadres and civil servants with changes in professional qualifications and skills to the Department of Home Affairs of Khanh Hoa province.
Accordingly, the Department of Home Affairs of Khanh Hoa province said that Clause 1, Clause 2, Article 16 of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government stipulates:
Commune-level cadres and civil servants who have completed the training course according to the standards on professional qualifications and skills specified in this Decree will be arranged in salary as administrative civil servants with the same training course as the professional and technical training course specified in the salary table for cadres and civil servants in state agencies issued together with the Government's Decree on salary regime for cadres, civil servants, public employees and armed forces.
The qualification for the training program is implemented according to the regulations of the Ministry of Education and Training and the competent authority or organization issuing the certificate.
In case during the working period, commune-level cadres and civil servants have changes in their training qualifications in accordance with their positions and titles, they will be proposed by the Chairman of the District People's Committee to arrange salaries according to the new training qualifications from the date of being granted a good reputation certificate.
However, Clause 3, Article 71 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government stipulates: Repealing relevant regulations on commune-level civil servants in Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups.
For example, this Department questions about cadres and civil servants working in communes, wards and towns before the arrangement of salary levels for cadres and civil servants, if during the working period, cadres and civil servants at the commune level have changes in training levels in accordance with the position and title they have held, will they be paid according to the salary level of specialists as prescribed in Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government?
Similarly, for civil servants who previously worked in district-level professional departments who were entitled to salary in cadres' ranks and employee ranks after being reorganized as commune-level civil servants in the new administrative unit from July 1, 2025 with a university degree, will the salary transfer according to professional qualifications be applied as to commune-level cadres and civil servants under the subjects specified in Decree No. 33 above?
To ensure the rights of these cases, the Department recommends that the Ministry of Home Affairs provide specific instructions on salary classification for the above cases.
Regarding the above content, the Ministry of Home Affairs said that, based on the Law on Cadres and Civil Servants and Clause 3, Article 71 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government, it stipulates: "Remove relevant regulations on commune-level civil servants in Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups".
Accordingly, the salary arrangement for commune-level civil servants is implemented consistently according to the general salary regime applied to cadres and civil servants according to Government regulations.
