Hanoi requires leaders to declare all red books, money, precious metals, and foreign assets
Hanoi has just issued an official dispatch requesting declaration and control of assets and income for people with positions and powers in organizations and units in 2025.
The Hanoi People's Committee has just issued Official Letter No. 6823 on implementing the work of declaring and controlling assets and income of people with positions and powers in agencies, organizations and units in 2025.
Accordingly, agencies, organizations, and units that manage and use people with the obligation to declare must organize the declaration according to the provisions of Articles 37, 38, of the 2018 Law on Anti-Corruption and Article 5 of Decision No. 45/2022 dated December 13, 2022 of the City People's Committee on controlling the assets and income of people with positions and powers at agencies and units under Hanoi City.
Assets and income that must be declared include: Rights to use land, houses, construction works and other assets attached to land, houses, construction works (red book); precious metals, gemstones, money, valuable papers and other real estate with each asset worth VND50 million or more; assets and accounts abroad; total income between 2 declarations.
For initial declaration: First-time hold the position as prescribed in Clauses 1, 2 and 3, Article 34 of the Law on Anti-Corruption 2018. The declaration must be completed no later than 10 days from the date of receipt, recruitment, and assignment to the position.
Supplementary declaration is carried out when the person subject to declaration has fluctuations in assets and income with a value of VND300 million or more. Declaration must be completed before December 31, 2025, except in cases where it has been declared annually.
For annual declaration: People holding positions from department director and equivalent or higher; civil servants holding positions as prescribed in Clause 1, Article 10 of Decree No. 130/2020 dated October 30, 2020 of the Government; those holding leadership and management positions from deputy department heads and equivalent or higher working in a number of areas specified in the list of Appendix III issued with Decree No. 130/2020 dated October 30, 2020 of the Government; representatives of state capital at enterprises. The declaration must be completed before December 31, 2025.
Declaration for personnel work is carried out in the following cases: People with the obligation to declare as prescribed in Clauses 1, 2 and 3, Article 34 of the Law on Anti-Corruption 2018 when expected to elect, approve, appoint, reappoint, or appoint to other positions. The declaration must be completed no later than 10 days before the expected date of election, approval, reappointment, or appointment to another position.
Persons with the obligation to declare as prescribed in Clause 4, Article 34 of the Law on Anti-Corruption 2018. The declaration time is implemented according to the provisions of the law on election.
Agencies, organizations and units are responsible for accuracy and completeness when approving those who are obliged to declare assets and income under their management authority according to regulations.
The City People's Committee requests heads of agencies, organizations and units to organize propaganda, dissemination and guidance on asset and income declaration; receive, manage and hand over asset and income declaration and publicize asset and income declaration to those who are obliged to declare assets and income according to regulations.
Agencies, organizations and units shall hand over the declaration of assets and income of the person subject to declaration to the competent asset and income control agency according to regulations.
