Conditions for admission to civil service for non-professional commune workers
The standards and conditions for being accepted as a civil servant have been specifically stipulated in Decree No. 170/2025 dated June 30, 2025 of the Government.
Mr. Hoang Van Binh (character's name has been changed), a part-time worker at the commune level since 2014, has submitted a petition to the Ministry of Home Affairs.
He cited the provisions in Point g, Clause 1, Article 13 of Decree 170/2025/ND-CP of the Government, in which part-time workers at the commune level are eligible to be accepted as civil servants.
In addition, Point b, Clause 3, Article 13 of this Decree also clearly states: "In the cases specified in Points b, c, d, e, g and h, Clause 1 of this Article, there must be 5 years or more of work in accordance with the provisions of law, and compulsory social insurance contributions (if not continuous and have not received a one-time social insurance allowance, it will be accumulated, including the working time if previously held at the job position specified in Points b, c, d, dd, e, g and h, Clause 1 of this Article), doing a job with professional and technical requirements suitable for the job in the expected job position".
From the above regulation, Mr. Binh asked: For non-professional workers in communes who have worked for 5 years or more, doing a job with expertise suitable for the expected position, is it mandatory to have a university degree for 5 years or more?
In fact, this force previously did not require a university degree. According to Point d, Clause 1, Article 36 of Decree 33/2023/ND-CP, their professional qualifications only require intermediate level or higher.
Many cases of non-professional cadres working in communes when they first started working only have an intermediate or college degree, and after working, they study at university to meet the requirements. Therefore, their university degree period may not be enough for 5 years.
Regarding his proposal, the Ministry of Home Affairs responded on the Electronic Information Portal.
Regarding standards and conditions for being accepted as civil servants, they have been specifically stipulated in Clause 3, Article 13 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government regulating the recruitment, use and management of civil servants.
It stipulates: "In cases specified in Points b, c, d, e, g and h, Clause 1 of this Article, there must be 5 years or more of work in accordance with the provisions of law, and compulsory social insurance contributions (if not continuous and have not received a one-time social insurance subsidy, it will be accumulated, including working time if previously held at the job position specified in Points b, c, d, dd, e, g and h, Clause 1 of this Article), doing a job with professional and technical requirements in accordance with the job position expected to be received".
Therefore, the Ministry of Home Affairs said that in the case of non-professional workers at the commune level, they must ensure the standards and conditions in accordance with the above regulations.
