The project to recognize a type I urban area must seek opinions from the Provincial Police and the Military Command
The project to recognize a type I urban area must be reviewed, inspected, evaluated, and sent for comments from the Provincial Police, the Military Command, and departments and branches.
This is the content stated in Decree No. 35/2026/ND-CP of the Government detailing a number of articles of the Resolution on urban classification.
Decree No. 35/2026/ND-CP stipulates the procedures for proposing to recognize a type I urban area.
The People's Committee (UBND) at the provincial level assigns the specialized agency under the province to organize the preparation of the project to recognize a type I urban area; in case of hiring a consulting unit, it must comply with the provisions of the law on bidding.
The agency or consulting unit assigned to prepare a project to recognize the type of urban area organizes a survey and prepares a project according to regulations. In case the project creator is not the Department of Construction, there must be a document explaining the project and sending it to the Department of Construction for examination.
Within a maximum of 5 working days from the date of receipt of the project attached to the document of the project-making unit, the Department of Construction is responsible for reviewing, inspecting, and making preliminary assessments and explanations of the project, and sending them for comments from the Provincial Police, the Provincial Military Command and the provincial Departments and specialized agencies.
The document sent for comments must clearly state the content that needs to be consulted according to the functions and tasks of the agency to be consulted; in case the Department of Construction prepares a project, the Department of Construction is responsible for sending for comments from the agencies specified in this section.
Within a maximum of 5 working days from the date of receipt of the document requesting opinions from the Department of Construction, the agencies that are allowed to collect opinions are responsible for sending comments to the Department of Construction for examination.
No more than 10 working days from the date of receipt of the written comments, the Department of Construction shall review the project or complete the project if the project is directly prepared.
In case the consulting unit prepares a project, the Department of Construction shall send a notice of the inspection results to the consulting unit for completion, the notice must clearly specify the project completion time and send it to the Department of Construction for consideration to report to the Provincial People's Committee.
The Department of Construction's dossier sent to the Provincial People's Committee includes: Submission and report on inspection, explanation of the project and a summary table of explanations, accepting comments.
After receiving the submission from the Department of Construction, the provincial People's Committee will consider and submit it to the People's Council (PC) of the same level for approval of the project.
No more than 10 working days from the date of the Resolution approving the project of the Provincial People's Council, the Provincial People's Committee shall send a set of documents to the Ministry of Construction to organize the appraisal and recognition of a type I urban area.
No more than 5 working days from the date of receipt of the dossier, the Ministry of Construction shall issue a decision to establish an interdisciplinary appraisal council to organize the appraisal of the project.
The maximum time for the Appraisal Council to conduct appraisal and report to the Ministry of Construction is 30 working days, from the date of issuance of the decision to establish the Appraisal Council.
After the appraisal, including cases where the dossier must be completed (if any), the Standing Committee of the Appraisal Council shall report with the dossier to the Ministry of Construction.
Within a maximum of 5 working days from the date of receipt of the dossier, the Minister of Construction shall consider and issue a decision to recognize a type I urban area.
Within a maximum of 15 working days from the date of receipt of the decision to recognize a type I urban area of the Ministry of Construction, the People's Committee at the provincial level shall organize the announcement of the decision to recognize the urban type.
