Commune police have 7 tasks of electronic monitoring of criminals

This is the content stipulated in Decree No. 333/2025/ND-CP of the Government on the application of electronic monitoring (ES) measures and community reintegration for minors who commit crimes. These regulations take effect from January 1, 2028.

The Decree stipulates the responsibilities of agencies, organizations, individuals and families in implementing administrative procedures, specifically as follows:

The People's Committee of the commune where the defendant or defendant is residing is responsible for organizing the implementation of the decision on enforcement of enforcement for minors who are defendants or defendants; notify the agency that has issued a decision to apply the measure on enforcement on the results of applying the measure on enforcement;

Propose that the agency that issued the decision to apply the licensing processor measure be removed from the scope of supervision; notify the agency that issued the decision to apply the processor measure in cases where the defendant or defendant is awarded a certificate of Prompt Obligation.

Commune-level police advise to help commune-level People's Committees fulfill the above responsibilities and are responsible for the following:

First, when receiving the defendant, the defendant was prosecuted.

Second, the Head of the Commune Police Department issued a decision to assign police officers to directly manage, supervise, and support the accused and defendants to be prosecuted.

Third, manage, supervise, and support defendants and defendants to be prosecuted; make records when they violate their commitment obligations and report to the Chairman of the People's Committee at the commune level.

Fourth, support the defendant and defendant to comply with the regulations on the use of electronic medical records.

Fifth, organize the granting and recovery of electronic cigarette devices to the accused and defendants who are accused of electronic cigarettes.

Sixth, periodically every month or upon request, synthesize data, evaluate the situation and results of implementing the decision to apply administrative procedures within the scope of authority, report to the Chairman of the People's Committee at the commune level and competent authorities.

Seventh, verify, assign names and identify when receiving notices from competent authorities about the defendant or defendant being detained by the prosecution for acts of removal, destruction, disruption of the operation of the prosecution device or being removed from the scope of supervision.

Relevant agencies, organizations and individuals are responsible for coordinating with agencies, competent persons and families in implementing the decision to apply administrative procedures; providing necessary services to support defendants and defendants to receive administrative procedures;

Assist and facilitate the defendants and defendants to be prosecuted by the prosecution and fulfill their commitments; guide and assist the defendants and defendants to be prosecuted by the prosecution to comply with regulations on the use of prosecution equipment;

Evaluate the effectiveness of applying the method of prosecution to the accused and defendants, the defendant was assessed by the prosecution and proposed a solution (if any) to the Chairman of the People's Committee at the commune level.
