The Ministry of Home Affairs guides the salary and allowance regime for individuals performing civil service contracts.

Mr. Duong Van Quoc (character's name has been changed) said that he is currently a specialist of the Economic, Infrastructure and Urban Affairs Department under the Ward People's Committee, working under a labor contract regime to perform civil servant duties according to Decree No. 173/2025/ND-CP dated June 30, 2025 of the Government.

According to Mr. Quoc, up to now, there has not been any circular or legal document specifically regulating the allowance and bonus regime for people working under labor contracts performing civil service tasks according to Decree No. 173/2025/ND-CP.

Meanwhile, this decree only clearly stipulates the group of contract workers according to Decree No. 111/2022/ND-CP.

From the above reality, Mr. Quoc suggested that the competent authority soon issue legal documents clearly stipulating the salary, allowance and bonus regime for people working under labor contracts performing civil servant duties according to Decree No. 173/2025/ND-CP, in order to ensure rights and unity in the implementation process.

Clause 2, Article 10 of Decree No. 173/2025/ND-CP dated June 30, 2025 of the Government stipulates that individuals signing contracts (employees) clearly state:

Fully and on time, ensuring the quality of professional and technical tasks according to the agreement in the contract and other requirements of the agency, organization, or unit signing the contract (if any); being responsible before the law and the agency, organization, or unit for the implementation results;

Only information, documents, and equipment of agencies, organizations, and units serving assigned tasks are allowed to be used; strictly prohibited from using for the wrong purpose, revealing, losing, copying, or illegally transferring confidential documents, assets, or assigned products;

Ensure the conditions for performing tasks (professional capacity, support human resources, necessary tools, means, etc.) in accordance with the contract content and requirements of the agency, organization, or unit;

To be paid salaries, bonuses, remuneration, and contract rental regimes corresponding to the results and products according to the agreement in the contract and in accordance with the provisions of law;

Ensure working conditions according to the provisions of law, according to the regulations of the agency, organization, unit and according to the agreement in the contract; access to professional documents and necessary information to serve the work according to the regulations of the agency, organization, unit;

The working time under labor contracts for a number of professional and technical tasks prescribed in this Decree is counted as the basis for salary classification according to job position if recruited or accepted as a civil servant or public employee. The salary arrangement corresponding to the job position recruited and received shall be implemented in accordance with the provisions of law;

Responsible for compensation for damages if violating contractual obligations causing financial losses, loss of property, product damage or disclosure of confidential information and documents;

Comply with the provisions of the law on the protection of state secrets, internal rules, regulations, and professional regulations of agencies, organizations, and units.
