The commune level has the right to decide to temporarily suspend monthly social allowances
The authority decides to temporarily suspend monthly social allowances and monthly support for care and nurturing funds implemented by the Chairman of the People's Committee at the commune level.
Deputy Minister of Health Le Duc Luan has just signed and issued a Circular of the Ministry of Health regulating the division of authority of local authorities at two levels in the fields of social protection and prevention and control of social evils.
Regarding the implementation of regulations on professional standards for social work collaborators at the commune level, the Circular of the Ministry of Health clearly states that the authority to perform the tasks specified in Clause 2, Article 6 of Circular No. 07/2013/TT-BLDTBXH dated May 24, 2013 of the Minister of Labor, War Invalids and Social Affairs stipulates the professional standards for social work collaborators at the commune, ward and town level, and is implemented by the Chairman of the People's Committee of communes, wards and special zones (hereinafter referred to as commune level).
The Circular also clearly states that the authority to decide on the establishment and dissolvement of the Voluntary Social Working Group (hereinafter referred to as the Voluntary Working Group) prescribed in Article 6 and approve the operating regulations prescribed in Clause 1, Article 10 of Joint Circular No. 24/2012/TTLT-BLDTBXH-BNV-BTC dated October 22, 2012 of the Minister of Labor - Invalids and Social Affairs, Minister of Home Affairs, Minister of Finance stipulates the establishment, disolution, organization of activities and policies for the Voluntary Social Working Group at the commune, ward and town level implemented by the Chairman of the People's Committee at the commune level.
Regarding procedures and implementation procedures, the Ministry of Health stated: Based on the situation and practical requirements of social evil prevention and control in the management area, the Chairman of the People's Committee at the commune level shall consider the decision to establish a Volunteer Team and approve the Working Regulations of the Volunteer Team.
In case of changing the members of the Volunteer Team, the Chairman of the People's Committee at the commune level decides to change the members of the Volunteer Team; Based on the practical situation of the local work of preventing and combating social evils, the Chairman of the People's Committee at the commune level decides to dissolve the Volunteer Team.
Regarding the decision to temporarily suspend social allowances, the Ministry of Health clearly stated the authority to decide to temporarily suspend monthly social allowances and support monthly care and support funds as prescribed in Clause 4, Article 2 of Circular No. 02/2021/TT-BLDTBXH dated June 24, 2021 of the Minister of Labor, War Invalids and Social Affairs guiding the implementation of a number of articles of Decree No. 20/2021/ND-CP dated March 15, 2021 of the Government regulating social assistance policies for social protection beneficiaries (hereinafter referred to as Decree No. 20/2021/ND-CP) implemented by the Chairman of the People's Committee at the commune level.
Regarding the implementation procedures, the Ministry of Health guides the Chairman of the People's Committee at the commune level, based on the provisions of Clause 3, Article 2 of Circular No. 02/2021/TT-BLDTBXH, to consider the decision to temporarily suspend monthly social allowances and support monthly care and support funds.
Regarding guidance and professional training on receiving care and nurturing social protection beneficiaries in the community, the Ministry of Health clearly stated the authority to organize the implementation of guidance and professional training on receiving care and nurturing social protection beneficiaries in the community as prescribed in Clause 2, Article 4 of Circular No. 02/2021/TT-BLDTBXH implemented by the Chairman of the People's Committee at the commune level.
Regarding the decision to pay social allowances and support monthly care and support costs at the corresponding level.
The authority to decide on payment according to the corresponding level prescribed in Clause 1, Article 5 of Circular No. 02/2021/TT-BLDTBXH shall be implemented by the Chairman of the People's Committee at the commune level.
The Ministry of Health stated that this Circular takes effect from July 1, 2025; This Circular expires from March 1, 2027.
During the effective period of this Circular, if the provisions on the authority and responsibility for state management in this Circular are different from the Circulars issued by the Minister of Health before July 1, 2025, they shall comply with the provisions of this Circular.
During the implementation process, if there are any problems, organizations and individuals are requested to promptly report to the Ministry of Health for further research and guidance.
