Prohibit counterfeiting and fraud to take advantage of high-tech incentives
The Law on High Technology prohibits forgery and fraud in meeting criteria and conditions to enjoy support policies and incentives for high technology and strategic technology.
The Office of the President has announced the President's order on the High-Tech Law passed by the National Assembly at the 10th Session.
This Law stipulates high-tech activities, policies and measures to encourage and promote high-tech activities and activities related to strategic technology development.
According to the Law, the Government unifies the management of high-tech and strategic technology activities nationwide; allocates budgets, mobilizes resources; issues specific mechanisms and policies; directs and coordinates ministries, branches and localities; promotes international cooperation.
The Ministry of Science and Technology is the focal agency responsible to the Government for implementing unified state management of high-tech and strategic technology activities according to the provisions of this Law.
At the same time, preside over advising on the development of policies to promote the development of high-tech and strategic technology activities; preside over and coordinate the development and promulgation of a special national science, technology and innovation program on strategic technology;
Develop a database and digital infrastructure; synthesize the results of the assessment of the effectiveness of high-tech and strategic technology activities; inspect and handle violations according to the provisions of law.
Ministries and ministerial-level agencies, within the scope of their assigned functions, tasks and powers, are responsible for implementing state management of high-tech activities and strategic technology in the assigned sectors and fields;
Incorporate the contents and plans for developing high-tech activities and strategic technologies in planning, strategies, and industry plans; take the lead in developing a controlled testing mechanism under management.
The provincial People's Committee, within the scope of its assigned functions, tasks and powers, is responsible for implementing state management of high-tech activities and strategic technology in the locality; implementing policies for high-tech development, strategic technology; developing technical infrastructure...
The law also stipulates 6 prohibited acts such as prohibiting the exploitation of high-tech activities and strategic technologies to infringe upon national interests, the legitimate rights and interests of organizations and individuals; causing negative consequences for national defense, security, social ethics, public health and the environment.
Prohibit the use of high technology, strategic technology or products and services formed from that technology to commit acts that violate the law.
Prohibit infringement of intellectual property rights over high technology, strategic technology, related products and services.
In particular, it is forbidden to forge and deceive in meeting criteria and conditions to enjoy support policies and incentives for high technology and strategic technology.
Prohibit illegal disclosure, purchase, sale, and transfer of technology secrets, data, and information related to high technology and strategic technology.
Or prohibit illegal obstruction or intervention in high-tech and strategic technology activities.
This Law takes effect from July 1, 2026.
