Positions appointed and appointed when merging provinces and establishing new communes

The National Assembly Standing Committee has just issued a conclusion on preparing documents related to amending and supplementing a number of articles of the 2013 Constitution.

Accordingly, the National Assembly Standing Committee approved the content of the documents proposing to amend and supplement a number of articles of the 2013 Constitution and proposed to establish a Draft Committee to amend and supplement a number of articles of the 2013 Constitution.

The Standing Committee of the Law and Justice Committee is assigned to carry out procedures to propose that agencies send representatives to participate as members of the Draft Committee to amend and supplement a number of articles of the 2013 Constitution.

At the same time, receive and complete the documents to submit to the National Assembly leaders for signing and promulgation, and send documents to National Assembly deputies no later than April 25 for study, discussion and decision at the beginning of the 9th Session.

The National Assembly Standing Committee has given its opinion on documents under the preparation responsibility of the Draft Committee amending and supplementing a number of articles of the 2013 Constitution.

Including the draft resolution to amend and supplement a number of articles of the 2013 Constitution. Draft a plan to collect opinions from the people, sectors and levels on the draft resolution amending and supplementing a number of articles of the 2013 Constitution.

In order to have a basis to continue completing the dossier to submit to the National Assembly for consideration and decision, the National Assembly Standing Committee proposed that the Government, relevant ministries and branches, during the research and proposal process, amend and supplement a number of articles of the 2013 Constitution and laws and resolutions related to the arrangement and streamlining of the apparatus of the political system, combined with proposing handling options to institutionalize regulations related to the election of a number of positions.

Accordingly, the institution stipulates: "When implementing the merger and consolidation of provincial-level administrative units or establishing new commune-level administrative units, the positions of Chairman, Vice Chairman of People's Councils and People's Committees; heads and Deputy Heads of the National Assembly Delegation; heads of the People's Council's departments and members of the People's Committee are not elected, but the National Assembly Standing Committee, Prime Minister, Standing Committee of the Provincial and Commune People's Councils are assigned to take on the above-mentioned positions based on the announcement of the competent Party Committee for managing cadres and conducting the appointment and appointment of personnel to hold the above-mentioned positions.

In special cases, it is allowed to appoint personnel who are not People's Council delegates to hold leadership positions of newly established People's Councils at the provincial and commune levels".

This content has been stated in Conclusion No. 150-KL/TW dated April 14, 2025 of the Politburo guiding the development of a personnel plan for provincial Party committees subject to consolidation, merger and newly established commune levels.

The National Assembly Standing Committee assigned the Standing Committee of the Law and Justice Committee to receive and complete documents to report to the Draft Committee for amending and supplementing a number of articles of the 2013 Constitution as soon as it is established to promptly review and decide on the contents under its authority.

The National Assembly Standing Committee unanimously determined that from April 15, the above documents and records will be public documents to ensure favorable conditions for consideration and discussion at the 9th session and to collect public opinions on amending and supplementing the 2013 Constitution.
