The Ministry of Education and Training guides teachers on how to calculate seniority allowances
Is the teaching period eligible for seniority allowances and the Ministry of Education and Training has answered the question of whether teaching time is eligible for seniority allowances or not.
Mr. Nguyen Huu Tien graduated from the pedagogical program in 2013 and taught continuously under a contract from December 2013 to March 2017.
In April 2017, he was recruited as a civil servant with the title of Grade IV Primary School Teacher, code V.07.03.09. In November 2023, Mr. Tien was appointed and salary was classified as a Grade III Primary School Teacher with code V.07.05.29 and has participated in social insurance continuously since December 2013 until now.
On April 1, 2022, he was decided to receive a seniority allowance of 5%. Mr. Tien asked, is it in accordance with Decree No. 77/2021/ND-CP that he is eligible for seniority allowances for teachers? Is the time he has not been recruited and participates in insurance counted as seniority?
The Ministry of Education and Training responds to this issue as follows:
The seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2021/ND-CP dated August 1, 2021 of the Government.
Accordingly, the time for calculating seniority allowances for teachers includes teaching and education time with compulsory social insurance contributions in public educational institutions (or non-public institutions if employees are subject to compulsory social insurance according to the provisions of the law on labor and education).
Mr. Tuyen was recruited as a civil servant in the education sector in April 2017. Before this time, he had a contract teaching period at the school and participated in compulsory social insurance from December 2013 to March 2017. This teaching and education period with compulsory social insurance contributions is accumulated to consider receiving seniority allowances for teachers according to regulations.
When appointed to the professional title of teacher, no probationary period is counted, if the total time spent directly teaching and educating (continuous or accumulated) is 5 years (60 months) is counted for seniority allowance equal to 5% of current salary. From the 6th year onwards, each year will be charged an additional 1%.
