Salary reserve for those who cease to hold leadership and command positions

The Ministry of National Defense is organizing a consultation on the second draft of the Circular on policies and regimes when reorganizing and streamlining the apparatus in the Army to continue editing and perfecting documents.

Accordingly, Article 13 of the Draft Circular on policies and regimes when arranging and streamlining the organizational apparatus in the Army proposes policies for cases of ceasing to hold leadership and management commands or being appointed to leadership and management commands with lower position allowances due to organizational arrangement.

The subjects specified in this Circular, when ceasing to hold leadership and management command positions or being appointed to leadership and management command positions, have lower position allowances due to the reorganization of the apparatus of competent authorities according to the provisions of Article 11 of Decree No. 178/2024/ND-CP, amended and supplemented in Clause 11, Article 1 of Decree No. 67/2025/ND-CP.

For example, cadres, civil servants, and public employees who are leaders and managers who cease to hold leadership or management positions or are elected or appointed to leadership or management positions with a lower salary or leadership position allowance due to the reorganization of the apparatus will have their old salary or leadership position allowance retained until the end of the election term or the appointment term expires.

In case of holding leadership or management positions according to the election term or appointment term of less than 6 months, 6 months will be reserved.

The draft of this Circular has 18 things, an increase of 6 articles compared to the previous draft of the Circular; Expanding more subjects to guide the implementation of policies and regimes for subjects under the management of the Ministry of Defense in organizing the organizational structure; Rear payroll, restructuring, improving the quality of the team; officials who are not old enough to re -election, re -appointment or eligible for the age of re -election and re -appointment; Officers participating in the Party committees must end their activities in accordance with Articles 7, 8, 9, 10, 11 and 14 Decree No. 178/2024/ND-CP, Clause 5, 6, 7, 8, 9, 10 and 11, Article 1 of Decree No. 67/2025/ND-CP; responsibilities of relevant agencies, units and individuals.
