Total maximum number of extra teaching periods for schools paid overtime wages

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 1, Article 4 of Circular 21/2025/TT-BGDDT of the Ministry of Education and Training (effective from September 23, 2025) stipulates that the total number of maximum extra teaching periods in a school year for which educational institutions are paid for overtime teaching salaries is determined as follows:

The total number of extra teaching periods in a school year = [Thousall number of teaching periods for subjects, part-time, monthly, and educational activities of all classes according to the education program/school year or training program/school year + Total number of teaching periods calculated for performing other tasks/school year (if any) + Total number of teaching periods calculated for full teaching/school year (if any) - (Thousall teaching periods for all teachers/school year).

In which:

a) The total number of teaching periods is calculated to perform other tasks/school year including: the total number of teaching periods converted/school year according to regulations; the total number of teaching periods is calculated additional/school year according to regulations; the total number of teaching periods reduced/school year according to regulations;

b) The total teaching period quota for all teachers/school year includes: the total teaching period quota/school year of all teachers who have worked for one full year (excluding teachers sent to teach in an inter-school); the total actual teaching period of teachers sent to teach in an inter-school (if any)/school year at the educational institution where the teacher works; the total teaching period quota/real working time for cases of less than one school year of work (including teachers sent to and seconded to secondary schools).

The standard for teaching hours/real working time is calculated according to the provisions of Point a, Point b, Point c, Clause 2, Article 6 of this Circular.

Thus, from September 23, 2025, the total number of extra teaching periods in a school year is the maximum for which schools are paid overtime wages for teachers as above.
