Regulations on the dismissal of People's Council delegates at the commune level from September 26, 2025

The termination of the duties of a People's Council delegate at the commune level is based on the above mentioned in Resolution 104/2025/UBTVQH15.

Resolution 104/2025/UBTVQH15 on model working regulations of the People's Councils of communes, wards and special zones (collectively referred to as commune level) takes effect from September 26, 2025.

Clause 4, Article 16 of the model working regulations of the People's Councils of communes, wards and special zones (issued with the Resolution) stipulates the termination of the duties of People's Council delegates at the commune level as follows:

a) Based on the application for dismissal from the duties of the People's Council delegate, the Standing Committee of the People's Council shall consider and submit to the People's Council for decision on the dismissal from the duties of the People's Council delegate. During the period when the People's Council does not meet, the Standing Committee of the People's Council shall consider, decide and report to the People's Council at the nearest session;

b) The order and procedures for submitting to the People's Council for dismissal from the duties of People's Council delegates at People's Council meetings shall be implemented similarly to those prescribed in Clause 1 of this Article (regulations on the order and procedures for submitting to the People's Council to elect positions of the People's Council). The People's Council decides on the form of voting; in case of public voting, the Ballot Counting Committee will not be elected.
