Regulations on the term of the Standing Committee of the People's Council at the commune level

Clause 5, Article 29 of the Law on Organization of Local Government 2025 stipulates as follows:

Organizational structure of the People's Council

5. The term of the People's Council delegate is according to the term of the People's Council. The elected additional People's Council delegates begin their delegation duties from the opening date of the next session after the additional election to the opening date of the first session of the new term People's Council.

The term of the Standing Committee of the People's Council and the Committees of the People's Council is according to the term of the People's Council at the same level. When the People's Council expires, the Standing Committee of the People's Council and the Committees of the People's Council shall continue to perform their duties until the newly elected People's Council elects the Standing Committee of the People's Council and the Committees of the newly elected People's Council.

6. The National Assembly Standing Committee stipulates the standards and conditions for establishing Ethnic Committees of the Provincial People's Councils; the number of Vice Chairmen of the People's Councils, Deputy Heads of the Committees of the People's Councils at the provincial and commune levels, and the arrangement of People's Council delegates at the provincial and commune levels to work full-time.

Accordingly, the term of the Standing Committee of the People's Council at the commune level is the same as the term of the People's Council at the commune level. When the People's Council at the commune level expires, the Standing Committee of the People's Council at the commune level will continue to perform its duties until the newly elected People's Council at the commune level elects the newly elected People's Council at the commune level.

According to Clause 4, Article 5 of the Law on Organization of Local Government 2025, the term of each term of the People's Council is 5 years from the opening date of the first session of the People's Council of that term to the opening date of the first session of the new term of the People's Council. The shortening or extension of the term of the People's Council shall be decided by the National Assembly at the request of the National Assembly Standing Committee.
