Article 15 of the 2025 Law on Protection of State Secrets (effective from March 1, 2026) stipulates the provision and transfer of state secrets to agencies, organizations, and Vietnamese people as follows:

1. The person with authority specified in Clauses 1, 2 and 3, Article 11 of this Law decides on the provision and transfer of state secrets within the scope of management corresponding to the confidentiality of documents and objects containing state secrets that that person has the authority to permit copies and photos of.

2. The Minister of National Defense and the Minister of Public Security stipulate the authority to provide and transfer state secrets under their management.

3. Agencies, organizations and Vietnamese people assigned to perform tasks directly related to state secrets are requested to provide and transfer state secrets.

4. Agencies and organizations requesting to provide and transfer state secrets must have a document sent to the competent authority deciding on the provision and transfer of state secrets. The request document must clearly state the name of the agency or organization; the representative of the agency or organization; state secrets requested for provision and transfer; purpose of use and commitment to protect state secrets.

5. The person requesting to provide or transfer state secrets must have a document sent to the competent authority deciding on the provision or transfer of state secrets. The request document must clearly state their full name; personal identification number, passport number, People's Police ID card number or ID card number issued by the People's Army; contact address; working position; state secret requested to be provided or transferred; purpose of use and commitment to protect state secrets.

6. In case of refusal to provide or transfer state secrets, the person with authority to decide on the provision or transfer of state secrets must respond in writing and state the reason.

Thus, from March 1, 2026, the provision and transfer of state secrets to agencies, organizations, and Vietnamese people is regulated as above.
