New regulations on the authority to remove Chairman of Commune People's Committee

The Lao Dong Newspaper Legal Consulting Office replied:
Article 41 of the Law on Organization of Local Government 2025 (effective from June 16, 2025) stipulates the transfer and removal of the positions of Chairman of the People's Committee and Vice Chairman of the People's Committee as follows:
1. The Prime Minister decides to transfer the Chairman of the People's Committee and Vice Chairman of the Provincial People's Committee; the Chairman of the Provincial People's Committee decides to transfer the Chairman of the People's Committee and Vice Chairman of the Commune People's Committee.
2. The Prime Minister decides to remove the position of Chairman of the People's Committee, Vice Chairman of the Provincial People's Committee; Chairman of the Provincial People's Committee decides to remove the position of Chairman of the People's Committee, Vice Chairman of the Commune-level People's Committee when the Chairman of the People's Committee, Vice Chairman of the People's Committee violates the law or does not properly perform the assigned duties and tasks.
3. The Chairman of the People's Committee and Vice Chairman of the People's Committee who are transferred or dismissed from their duties shall cease to perform their duties from the date the transfer or dismissal decision takes effect.
4. The People's Council shall not carry out the procedures for dismissal or removal from office in the cases specified in Clauses 1 and 2 of this Article. The Standing Committee of the People's Council shall report to the People's Council at the nearest meeting for cases that do not carry out the procedures for dismissal and removal from the People's Council prescribed in Clauses 1 and 2 of this Article.
Thus, from June 16, 2025, the Chairman of the Provincial People's Committee decides to remove the position of Chairman of the Commune People's Committee when the Chairman of the Commune People's Committee violates the law or does not properly perform his assigned duties and tasks.
