Clause 1, Article 12 of Decree 93/2026/ND-CP detailing and guiding the implementation of a number of articles of the Law on Teachers (effective from March 31, 2026), stipulates the subjects and principles of transfer as follows:

a) Transfer subjects: teachers, teachers holding educational institution management positions in public educational institutions who wish to be transferred;

b) Principles of transfer: the transfer of teachers is carried out when the teacher has a need, must be approved by the educational institution, agency, unit where the teacher is transferred and transferred, and at the same time be consistent with the actual conditions of the educational institution, agency, unit regarding the job position; comply with the guidance and regulations on transfer of competent authorities.
