Trading data about employees fined up to 140 million VND
Businesses that illegally buy, sell, exchange, and appropriate information and data in the employee database may be fined up to 140 million VND.
Recently, the Government issued Decree No. 283/2026/ND-CP stipulating penalties for administrative violations in the fields of labor, social insurance, and Vietnamese workers going to work abroad under contracts (effective from September 10, 2026).
Notably, Clause 4, Article 10 of Decree No. 283/2026/ND-CP stipulates a fine of between 50 million VND and 70 million VND for organizations and individuals with one of the following acts:
Illegally buying, selling, exchanging, and appropriating information and data in the database on employees and information on the labor market that has not been announced and disseminated by competent state management agencies without being prosecuted for criminal liability.
Lawyer Nguyen Huu Hoc, Ho Chi Minh City Bar Association, said that also according to Decree No. 283/2026/ND-CP, the above fine is only applied to individuals. The fine for organizations is 2 times the fine for individuals.
Thus, if a business has acts of buying, selling, exchanging, and illegally appropriating information and data in the database on employees and labor market information that has not been announced and disseminated by a competent state management agency without being prosecuted for criminal liability, it may be fined up to 140 million VND.
