Non-public teachers temporarily suspended from teaching, still receive salaries
A reader with email xuanhuongxxx@gmail.com asked: If teachers in the non-public sector are temporarily suspended from teaching, will they receive their salary?
The Lao Dong Newspaper Legal Consulting Office replied:
Clause 3, Article 36 of the 2025 Law on Teachers (effective from January 1, 2026) stipulates as follows: For teachers in non-public educational institutions, the teaching suspension period and salary during the teaching suspension period shall comply with the provisions of the law on labor and other relevant provisions of law.
Clauses 2, 3, 4, Article 128 of the 2019 Labor Code stipulates:
2. The temporary suspension period cannot exceed 15 days, in special cases it cannot exceed 90 days. During the period of temporary suspension, employees are given an advance payment of 50% of their salary before being suspended from work.
After the temporary suspension period, the employer must accept the employee back to work.
3. In case the employee is subject to labor discipline, the employee will not have to return the salary in advance.
4. In case the employee is not subject to labor discipline, the employer will pay the full salary for the period of temporary suspension.
Thus, teachers outside the public sector who are temporarily suspended from teaching will still receive salaries according to the above regulations.
