Conditions for licensing national vocational skills assessment activities

Clause 1, Article 13 of Decree 138/2026/ND-CP detailing a number of articles of the Law on Employment on professional skills development (effective from April 7, 2026), stipulates that organizations are granted certificates of national professional skills assessment activities when they meet the following conditions:

a) Being an organization with legal status; having functions, tasks or registering business, production, and services suitable to the profession proposed for national vocational skills assessment organization;

b) Having facilities (specialized, technical rooms and houses, workshops, premises) and equipment (vehicles, equipment, tools, working instruments and measuring and testing equipment) according to the list of facilities and equipment for national vocational skills assessment for each profession issued by one of the competent agencies specified in Article 7 of Investment Law No. 143/2025/QH15 in 2025 to ensure correspondence with the number of participants in the assessment and issuance of national vocational skills certificates (hereinafter referred to as participants) in a professional and technical knowledge test (hereinafter referred to as knowledge test) or assessment of work practice skills and occupational safety and health procedures (hereinafter referred to as practice assessment) at a skill level of each profession performed at the same time;

c) Having a system of imaging and sound monitoring equipment connected via the Internet, ensuring real-time monitoring and storing the entire process of knowledge testing and practical evaluation;

d) Having an electronic information page to ensure that employees register to participate in the online national vocational skills assessment;

d) Having at least 03 official employees at an organization meeting the national professional skills assessment standards according to the provisions of Article 14 of this Decree.

Thus, from April 7, 2026, businesses wishing to be granted a certificate of national vocational skills assessment operations need to meet the above conditions.
