Proposal on the fine level for cars not engaged in transport business but signing passenger transport contracts
Amending Decree 168, the drafting committee proposed to add a fine of up to 14 million VND for cars that do not engage in transportation business but receive passengers.
The Ministry of Public Security has just issued a draft Decree amending and supplementing a number of articles of Decree No. 168/2024/ND-CP dated December 26, 2024 of the Government stipulating penalties for administrative violations of traffic order and safety in the field of road traffic; deducting points, restoring points for driver's licenses.
According to the drafting committee, after more than 1 year of implementing Decree No. 168/2024/ND-CP, it has basically met the requirements of strengthening the efficiency of state management, the results of handling violations have increased, and traffic accidents have decreased significantly compared to the same period.
However, the situation of road traffic order and safety is still complicated; the situation of vehicles not registered for transport business but still carrying passengers and goods to collect money, and "disguised" transport business vehicles, causing injustice and transparency in transport business activities, and at the same time causing tax revenue loss to the State budget.
That act is also aimed at evading state management of road transport; non-standard container trucks, trucks carrying cargo on trailers, semi-trailers with dimensions exceeding the length and height but there are no sanctions.
The drafting committee's issuance of a draft amending and supplementing a number of violations of transport business vehicles to comply with the law on road transport business: Driving a car that does not engage in passenger transport business but carries people for money or signing contracts, receiving reservations to carry people on the car; driving a car that does not engage in freight transport business but carries goods on the car for money;
Using passenger transport business vehicles under contracts that confirm reservations for each passenger to take vehicles outside the signed contract or sell tickets, collect money outside the signed contract, set fixed routes and schedules to serve multiple passengers or multiple different transport charterers;
Driving a passenger transport vehicle under a contract and picking up and dropping off passengers at the head office, branch office, representative office or at another fixed location leased or cooperated by a transport business unit, or picking up and dropping off passengers at a location not specified in the signed transport contract.
Accordingly, the drafting committee proposed to add clause 8a after clause 8 of Article 20 of Decree 168: A fine of between 12,000 VND and 14,000 VND shall be imposed on drivers of cars not engaged in passenger transport business but carrying people for money or signing contracts, receiving reservations to carry people on the car.
Currently, Clause 8, Article 20 of Decree 168 is in effect and stipulates: A fine of between 10,000 VND and 12,000 VND shall be imposed on drivers who perform the act of picking up and dropping off passengers on highways.
