Cases that are not allowed to be Head of inspection teams from August 2025

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 2, Article 23 of Decree No. 216/2025/ND-CP detailing and guiding the implementation of the Law on Inspection (effective from August 5, 2025) stipulates that people in one of the following cases are not allowed to be Head of the inspection team, Deputy Head of the inspection team:

a) Belonging to one of the cases specified in Points a, b, c and d, Clause 1 of this Article;

b) The person whose husband or wife, biological father, biological mother, biological father, mother-in-law or father-in-law, child, brother, sister, biological sister or biological brother, sister, biological sister of the wife or husband working at an agency, organization or unit is the subject of the inspection.

Clause 1, Article 23 of Decree No. 216/2025/ND-CP stipulates that people in one of the following cases are not allowed to join the Inspection Team:

a) People subject to disciplinary action or criminal prosecution who have not yet expired the statute of limitations for disciplinary action or records;

b) People undergoing disciplinary action or criminal prosecution;

c) The person contributing capital to the enterprise or having controlling shares in the enterprise is the subject of inspection, unless otherwise provided by law;

d) The person whose husband or wife, biological father, biological mother, child, brother, sister, or biological sister is the head or deputy head, the person in charge of personnel organization, accounting, treasurer or warehouse keeper in the agency, organization, or unit that is the subject of the inspection;

d) People working at an agency, organization or unit who are subjects of inspection or are in a case of conflict of interest as prescribed by law.

Thus, from August 5, 2025, the above cases will not be allowed to be Head of the inspection team.
