Regulations on Trade Unions participating in inspections and examinations

Accordingly, the Trade Union is responsible for participating and coordinating with competent State agencies to inspect and examine the implementation of regimes, policies and laws on trade unions, labor, employment, wages, cadres, civil servants, public employees, social insurance, unemployment insurance, health insurance, occupational safety and hygiene and other regimes, policies and laws related to the rights and obligations of workers.

When checking and inspecting content directly related to the legitimate and legal rights and interests of workers and trade union organizations, the competent State agency is responsible for inviting trade union representatives to participate.

Article 15 also stipulates that when participating in inspection and examination, trade union representatives have the duties, powers and responsibilities according to relevant legal provisions and the following rights and responsibilities: Requesting agencies, organizations, units and enterprises to provide information, documents and explain issues related to inspection and examination content; recommending measures to prevent, repair, overcome consequences and handle violations of the law; requiring agencies, organizations, units, enterprises and individuals to immediately implement remedial measures, ensure occupational safety and hygiene, even in cases where they have to temporarily suspend operations in case of detecting workplaces with harmful factors or factors that threaten the health and life of workers.

In the 2012 Trade Union Law, the rights and responsibilities of Trade Unions in participating in inspection, examination and supervision of the activities of agencies, organizations and enterprises are stipulated in Article 14.
